TERMS OF TRADE
1.0 Payments1.1 Payments of items brought in-store shall be paid for immediately unless arrangements have been made between the Customer and Clear Pools. These specific payments are to be made either within 7 days of purchase or by the 20th of the following month. Clear Pools may require proof of purchase through credit, or upon receipt of invoice. 1.2 Any invoice received via email will be made within 7 days of receiving the invoice unless stated differently on the invoice. 1.3 A callout fee will be charged to every customer no matter how long the job takes to complete. A travel charge will also be incurred on top of the callout fee although pricing will change depending on how far in km/h the travel is.1.4 If a payment is overdue then the Customer may be charged a Finance Charge on all overdue accounts of either 3% or 55.00 per month, whichever is the greater, plus any other charges or fees that may apply until the payment is made in full. 1.5 ln the unlikely event that there remain any unpaid invoices, accounts may be passed on to a debt collection agency. The Customer will be liable for any costs associated with this service in addition to the overdue amount the Customer owes.1.6 Clear Pools may at its own discretion withhold any further work or ordering of parts the Customer requires until the overdue payment has been made in full. In the future, Clear Pools may ask for advanced payment before starting or completing a job. All goods and products remain the property of Clear Pools until paid for in full. 1.7 Certain items and products sold by Clear Pools to the Customer may require a deposit without prior warning.1.8 Store credit will be valid for 1 year from the date on which it is paid. Any credit remaining in the Customer's account after that year may be accepted as a direct debit. 1.9 If the NET TOTAL of the invoice paid is less than $5.00 the money accepted will be put through as a direct debit.
2.0 Cancellations2.1 If the Customer is to cancel their scheduled visit, job, spa or pool valet service within 12 hours of the set time a cancellation fee will be incurred to the Customer.2.2 If a product has been specifically ordered on the Customers behalf by Clear Pools for an upcoming scheduled, unscheduled, or follow-up job the customer must pay for 50% of the part ordered if they cancel the job. The part must still be paid for if the cancellation occurs outside or within the 12-hour cancellation fee period. If the job is cancelled within 12 hours, a cancellation fee will be charged on top of the 50%.2.3 The regular pool valet service is 2 weekly (October-March) in summer and 4 weekly (April-September) in winter. If the customer requests to change the schedule on their own, outside of the arranged scheduling system, we will adjust the schedule for the following month from the day of the request. 3.0 Pool Equipment1.3 If Clear Pools is to install any filters, ozone, or chlorination equipment of pumps for the Customer the equipment must provide a shelter to protect the equipment. For best results, any heat pump must be installed in an area that avoids cold exhaust air recirculation and is not enclosed.
4.0 Privacy act 19934.1 Any details given to Clear Pools by the Customer will be entered into our customer database. Any photos of the pool and pool products are taken while working on the job, will be entered into our database, under the Customer's name. If the Customer does not wish for this to be the case, they must inform Clear Pools in writing. Any photos taken may also be used on the Clear Pools website. We will keep on file the Customer pool information even after the pool is completed. We hold the right to keep a customer database for our files. This information is classified for Clear Pools business.
5.0 Unforeseen circumstances5.1 Clear Pools will not be held accountable for any unforeseen circumstances such as weather, freight complications, and or complications outside of Clear Pool's control, that prolong the completion of any work they have or have not yet started. Clear Pools will make every effort to meet the expectations of the Customer, however, no guarantee is given on the start date or completion date of work done that is affected by unanticipated circumstances.
5.0 General 5.1 Valet Services run on a weekly, fortnightly, and four-weekly schedule. If the Customer is on a four-weekly schedule they may have a valet service twice a month depending on the way that their scheduled days fall, during the term of their four-weekly schedule.5.2 The terms and conditions laid out above apply to all items sold by Clear Pools to the customer, as well as any valet service or callout job. By scheduling a job with Clear Pools, buying a product, or agreeing to the ordering of a part to be brought in from a separate supplier on behalf of the Customer, the Customer accepts acknowledgement of these terms and conditions and agrees to them. 5.3 Unless there is a written agreement between Clear Pools and the customer these terms and conditions cannot be changed. 5.4 Clear Pools requires no notification to the Customer if prices and specifications are to change throughout the year. However, these notifications may be given out of courtesy. Surcharge 2.5% with paywave or credit card payments in the retail shop
